I am EB2 and have a Masters but I don't support your case or even the basis of it. Mostly it is because I don't think MOST of the folks who use PD porting are doing it illegally or even cutting through the line undeservedly. If I am not wrong, these folks will have put in the time (work exp wise and/or added higher education) and should rightfully get the position certified as EB2.
Now granted that there are always a small minority people who genuinely are not deserving. First, can you define in your view what kind of PD porting is unethical?
Additionally, can you back up your claims by providing any kind of stats of such cases per year and how much impact it really causes to the GC wait time of those already waiting in queue for EB2? Are they that significant for you and Rolling Stone to feel so wronged?
In conclusion, unlike the unjust labor substitution process, your case is not convincing because I don't think most people availing PD porting are doing anything wrong legally and ethically. I would love to see stats and examples though.

Anyways, this clears the way for next items on Senate's agenda. Immigration is one of them. Unless the hearings on NSA wiretaps take too much time and energy out of the Senate Judiciary committee. Hopefully they wont come in the way of immigration reform.

Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.
You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????
Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!

Based on just released information, it appears that India EB2 cutoff dates will advance, perhaps substantially, in May. China EB2 cutoff dates will also advance. The American Immigration Lawyers Association (AILA) reports that they were told the following by Charlie Oppenheim, Chief, Immigrant Visa Control and Reporting Division, U.S. Department of State:
�[US]CIS says they have seen a decline in filings, and does not expect a change in the number use pattern. Therefore, this decline in EB-1 number use will allow me to begin having those �otherwise unused� numbers drop down and be available for use in the EB-2 category. Based on current indications, that would mean that at least 12,000 additional numbers will be available to the EB-2 category. This situation will allow me to advance the India EB-2 cut-off date for May. The reason being that all �otherwise unused� numbers are provided strictly in priority date order, and the India demand has the largest concentration of early dates.�
There have been two reasons for China and India EB2 cutoff dates not moving forward as rapidly as had been the case in the past. The first is the unusually high demand for EB1 numbers and the second has been the increased demand for EB2 numbers represented by EB3 to EB2 upgrades.
The significance of this announcement is that it appears that the recent surge in demand for EB1 visa numbers has abated. The CIS reports that this demand slowed down in October, 2010 and has not resumed. Presumably, this means that substantially most the EB2 applicants who felt that they could upgrade to EB1 have now filed the petitions and had them adjudicated. What stopped (from legal stand point) MBA guy to file for eb3 based GC in 2003? Remember both have BS in Engineering at that time. No employer was ready to file GC for the MBA guy (in 2003) is not a valid legal argument.
Remember, one does not need to be employed to file for GC and GC is for the future job.
It is not what you or I think is fair. From legal point of view, both had equal opportunity to file for GC in 2003 for eb3 job. Just because, the MBA person didn't go for it is not a valid argument. Don't you agree?
