Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.
As I said I am against bailout. As none of these people/organizations should be bailed out. On this issues I resonate with you and boreal.
But if I am in situation like Punjabi I will think in similar way. I think he has got enough suggestions for him. He needs to decide whether 20k is worth foreclosing.
On living rich, I prefer living decent in long run than living rich for a few days and then suffering later ..

This is my opinion, not an advise. Use it at your own risk.
How to find out if you name check has been done/cleared.
What do you think will EB2 I will get stuck in March 2005 for the rest of USCIS year untill September? I think Quarterly spill over is the name of the game now.

Another question, i got my I140 approved from Texas center although filed at NSC (premium processing). Will my I485 apps also be handled by Texas or they are independent?
I got this from :http://www.usvisahelp.com/filingtips2.html
"Note that an employment-based I-485 application that is filed concurrently with an I-140 immigrant petition must also be filed at the Nebraska Service Center, since all I-140 petitions are now filed at Nebraska. However, an I-485 application filed to accompany a currently pending I-140 petition would be filed either at Nebraska or Texas, depending upon which service center issued the receipt notice for the I-140."
According to this, I guess your I-485 should be handled by Taxas service center. But don't take this as the final answer. Check with your lawyer to make sure.
Anyone with H1B after 2004 has seen any delay???
This forum has provided an incredible amount of information for ignorants like me. Please keep on updating this thread with your experiences and details. Mention your approval dates also.
H1b approval notices are for 3 yrs. So most folks who are going for stamping now will have approval dates much after Jan 2005. So DOS claiming that all cases after 2004 is not correct.
I'm probably not going to participate in the lawsuit because I don't want to divide an already weakened community. Neither will I try to stop it because I think it raises some valid questions.
I personally think that IV needs to make some changes and the first step would be to stop quoting figures like "we have 25K members" when the reality is that hardly 200 people participate in the call campaigns and it was due to random strangers that we were able to collect 5000 signatures for the administrative fixes. Most people come to IV to get some easy answers or to pass time by playing some games like the visa bulletin predictions game or the identify the TSC approval pattern game, etc. Only the core is working relentlessly for us besides a handful of volunteers. I think that there are enough agony aunts for immigration issues and IV should be exclusively for immigration related lobbying and legislation. It's the only way we can get rid of the 25K - 200 people who do nothing and then focus on the real issues.
This reminds me:
Car = $30,000
iPhone = $200
House = $450,000
Icecream = $2.50
TV = $500
There are some things money CAN buy, For everything else, there's GREEN CARD
(i don't know what everything else is though...LOL)
To add a few more conditions to the aforesaid situation...
This is 2008.. Both JE and MBA are thinking that they will get their GC in 2009...
Meanwhile they start arguing.. and many like them join their verbal-struggle..
Because of this, IV community is divided.. Earlier only 200 people used to respond to action items .. now because of the rift only 100 do... this weakens the momentum that the campaign had..
Meanwhile, NumbersUSA et all increased their efforts..
Anti-immigration forces are united and under their pressure all the EB relief bills fail...
Election is close USCIS shifts the focus to FB visas..
EB backlog, retrogression goes up..
JE and MBA still fighting their verbal fight... in same line.. still fighting with words... with few more years added to their wait-time.

RNC Bows to Bush, Kills Immigration Resolution
By John Gizzi
Human Events Online, January 22, 2006
. . .
Given the growing chasm between the Administration and GOP grass-roots activists on the issue of illegal immigration, the Pullen measure could well have paved the way for the most incendiary debate at an RNC meeting since the partys ruling members eight years ago voted down a measure to deny funding to candidates opposed to a ban on partial birth abortion.

The Illegal Immigration Lobby
By Don Feder
GrasstopsUSA.com, January 17, 2006
. . .
Similarly, every call for immigration reform is answered with lusty shouts of racism by the self-styled champions of immigrant rights.
You want to start protecting our borders? Youre a racist. You think illegal aliens are responsible for a disproportionate share of crime, disease, poverty and social disintegration? Youre a racist. You believe America has a national language, and it isnt Spanish? Youre a xenophobic, hate-monger (even if youre an immigrant or the grandchild of immigrants).

Threat to Immigration Reform
San Antonio Express-News, January 23, 2006
. . .
Illegal immigration is a hot-button issue these days, and calls for a border fence spark fierce support among some segments of society.
That support is misplaced; undocumented workers who risk death to cross the border will not be deterred by a wall.

What's FAIR Got to Do With It?
By Tom Barry
International Relations Center, January 19, 2006
The House's approval of the Sensenbrenner immigration reform bill in mid-December was a clear signal that the most virulent restrictionists were in control of the immigration policy debate.
Sponsored by Rep. James Sensenbrenner (R-WI), chair of the House Judiciary Committee, the Border Protection, Anti-Terrorism, and Illegal Control Act calls for the extension of a fence along a third of the 2,000 mile U.S.-Mexico border, involves local law enforcement and other government officials in immigration enforcement, and denies due-process of law for immigrants. The bill sparked a spate of international criticism of rising anti-immigrant sentiment in the United States , and raised alarm among immigrant communities and their advocates.

So life is not always easy. There are people waiting since 2002-03-04.
Don't think that life is not a FIFO always.
Why some of the guys became violent when I said, INDIA IS GREAT???
Guys.. do you know why I always feel like this???
As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.
Someone asked me to pack up... YES, I will if nothing happens;however, I will be waiting to see the progress for sure. This is July. Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".
Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.
In the name of thinking differently we have smitha, senthil1 , asdqwe..and these guys confusing this struggle / fight for us trying to get ahead of the line or as senthil1 keeps saying uscis/dos made an honest mistake and asdqwe..keeps saying we need to fight for legislation rather than wasting time with these efforts. What all these guys and their ilk fail to understand is most of us are pissed off about the way it was implemented and handled rather than the ability to file AOS itself. If we sit and do nothing is like asking uscis / dos to walk all over us again and again. Besides in US law whenever there is a gray area, the decisions are based on precedents. This means if they have done this now means they can do this in any bulletin hence issued. They can issue a bulletin in Oct 2007 and on Nov 2 say "oops sorry my bad wrong bulletin" . Please come out of the basement and face the sun.

A lot of lawyers try to preempt a possible RFE by including "AS MUCH AS POSSIBLE" documentation. 3 years of tax returns prove nothing more than what 1 year of tax return would prove.
Also, having a tax return of 2004 doesnt prove that you were in status at all times during 2004. Tax return shows total income that includes salary, bonus, deductions etc, and even Einstein cant figure out the immigration status in 2004 and whether the candidate was in good status at all times just by looking at the tax return.
Some lawyers send many years' tax returns, thinking that it might pre-empt the RFEs. Some lawyers send only whats neccesary. I've heard that one of the lawyers in New York doesnt even send employer's letter. That means, basically nothing from the employer. And he too gets cases approved.
Overloading the USCIS with a heavy file, sending a ton of things in addition to what they expect, may be a good strategy if you believe that it might thwart a RFE (and the delay caused by RFE). However, sending too thick a bunch, would also make your case look like a "difficult" case. (my belief, I dont know but just common sense would indicate that thicker bigger files are complicated cases if you give it a first look). And what that means is that it will get delayed because the CIS ombudsman report has documented that officers tend to work easy cases first (get the low hanging fruit first) and beef up their performance statistics by doing more cases in less time. Therefore, the complicated bigger cases that should be work on first, instead get worked on last.
So think a little before sending USCIS 20 pounds of paperwork. More paperwork and overwhelming USCIS with documentation may not mean faster RFE-free processing. (Again, my belief - something to ponder about. But do what you think is right and what your lawyer tells you. I am not a lawyer).

"Cite as "AILA InfoNet Doc. No. 11040563 (posted Apr. 5, 2011)"
Following-up on his earlier observations on EB-1 demand and "spill-down" to EB-2 reported on InfoNet on March 29, 2011 (InfoNet Doc. No. 11032960), Charlie Oppenheim discussed scenarios for EB-2 movement in the coming months. In preparation of the May 2011 Visa Bulletin, DOS will consider the approximately 12,000 unused EB-1 numbers that will "spill-down" to EB-2, EB-2 demand and possible unused numbers, and will consult with USCIS on its processing potential. A quick look by DOS at this point indicates that there is the possibility for greater advancement of the India EB-2 category than had earlier been thought. Doing so will give DOS better visibility into EB-3 upgrade demand in the pipeline, and will better ensure that all visas allowed annually are used. However, a rapid advance could spur a surge in demand that could impact the cut-off dates later in the year. The May Visa Bulletin, generally issued mid-April, will contain a discussion of visa availability projections for the remainder of the year.

I am currently working in Skilled visa through one of MNC company.I am working for this company for last 4 years and prior to this company i worked in another small company for two years.When I join my current company i provided all the legal document like exp,last two month pay stub and releiving letter and they did BG . They did not find anything wrong with prior employer in last 4 year. recently they found something wrong about my prior employer and asking me providing additional document and unfortunately company is closed or rename. I have told my current employer that i don't have any more evidance of my prior employer.Because of this reason they are asking me to come back india.
Is there any way that i can take legal action against this company in US because from last one week
they are harrassing my like anything.
Please let me know if anyone come across in this situation.
They are just giving you BS. They are trying to use a fake reason to send you back to India. They might be using this fake reason (BG check) to avoid any legal hassles. Keep track of how they are harassing you, keep a copy of all emails and documents used in correspondence in this matter and complain to DOL.
I also received response to SR for me and my spouse that our cases are under review and allow them 60 days. Did you send an e-mail to TSC after you received the response to SR or before. Also what did you write to them in the e-mail. If you can share that would be great. I am still waiting after becoming current in Sept.
I received a similar response to the 2nd SR. I was told that my case was under additional review and to allow them 60 days. However, my wife's case had been assigned to an officer for review.
Did you send an email to TSC.Ncscfollowup@dhs.gov (for TSC - another email for NSC). I had no clue where my application was when even 2006 cases were getting approved. I am seeing some movement after emailing them.
