    I just got my EAD yesterday (with 1 year validity even though PD is not current). My company lawyer will contact USCIS about this, will update once I have any info.

    Received only one year EAD .I will have to call USCIS for incorrect validity date of issued EAD.

    Did anybody contact USCIS regarding 1 year validity?

    Thanks for your post. It does look like EB2 India and EB3 Other Workers will remain where they are. The point to be noted is that EB3 India was not commented upon i.e. EB3 Other Workers is different from EB3 India or EB3 ROW. I don't want to commit the deadly sin of predicting but there is hope that EB3 India might move albeit slowly :p
    Yes that's true. Wonder why the "current" level of demand for EB2 India is higher than that for EB3 India.

    BTW, current for USCIS means you have to do significant travel in time backwards. :)

    This is the simplest Action Item ever, no travel, no holding placards, no visits to lawmakers, no real world activity. All that's needed is pen, paper, envelope and a stamp.I can't imagine anyone here who cannot afford any of these items.

    Most members here will benefit here by 3 year EAD/APs, job flexibility and promotions. Members who missed the July VB boat, and new applicants, will get to apply 485 and get into the line. There was a hue and cry sometime back about restarting I-40 PP. Even that group stands to benefit as their demands are included too.

    Hence the current low-level of participation is surprising. If we cannot collectively write even a letter for our cause, we might as well pack up or stop waiting/discussing VBs. They will be bleak for at least 4-5 years more. Come on folks, we can do better than this. We will write those letters and we'll succeed.

    Write those letters and update the tracker. Your kids will thank you for it when they growup (all the money saved from 10 years EAD/AP can be turned into savings for them)

    The person looking at this letter might spend like 10 to 15 seconds glancing at it.

    So we need to include like a subject line that in one sentence or two captures the essence of our issue(s). Something like:

    Subject: LEGAL Skilled Immigrants - Issues faced with Employment Based (EB) Green Card process.

    I liked the above 2 letters. If some one can frame a good letter, we can all send the letter to the senators as well as white house. Also we can get our state chapters involved and post all the letters within 2 weeks.

    He has just one option, get the laws changed. Not beating the dead man but folks should understand the importance of IV activities.
    Look at the state of affair of Tri State, thousands of people like these but only 25 so far signed up for DC rally. Not enough to fill even one bus WHAT A SHAME!
    Give the guy a break...he's just asking around as to what his options are... besides, one can't 'GUARANTEE' for how long a period of time one would have to wait as far as priority dates are concerned. The July Fiasco confirmed that, if anything...I agree that the rally is very important in making further strides, however there's no reason to be so harsh...

    abhidos37, unfortunately since your application was received when your priority date wasn't current, you're going to have to wait until your priority date becomes current again.

    Also I agree what Logiclife said when it comes to payments..

    I went thru COBRA for the last 2 months I tell you its a PAIN IN THE A##.
    Yeah premiums are very high. due to some gross miscommuniation on the provider they cancelled my COBRA for december since they didnt recieve payment.

    ONce you quit our current job, you will get within 7-10 days details from ur current insurance cpmpany or a third party administrator which ur company uses. They will also send a payment coupon. (not a discount coupon..).

    I hope your new company is paying the COBRA reimbursements for you...if not there is a loop hole in COBRA taht you can use and NOT pay the payments since you will have grace period. HOWEVER please keep in mind that the new insurance with your new company may have some restrictions on pre existing conditions...so keep an eye on that..since its for 30 days you will get on to a new insurance personally I wouldnt care for CBORA if the premiums are too high, why becuase, remember the coverage is RETROACTIVE, so you can get a claim reimbursed later after within the grace period

    I am in May 2003 EB3I boat. My employer is now trying to file my case in EB2. I have a master degree and 5 yrs experience prior to my EB3 filing in May 2003. The questions is regarding what to file and cost.

    Do we need to file 1. PERM 2. I140 3. I485 all over again ? If so here are the fee for each step 1. 2750 2. 475 (1250) 3. 1010 each(2000 for applicant and spouse. The ones in () are legal fees. Is this sound reasonable ?

    Your employer will have to file a PERM and I-140 and once I-140 is approved in EB-2 with earlier EB-3 PD, request USCIS to adjudicate your pending I-1485 using the newly approved EB-2 I-140. No need to file another I-485 if you already have one pending.

    Regarding the fee, there is no filing fee for PERM. All the costs are related to advertising and lawyer fee. I have no idea how much the fee for the whole process is or what attorney's charge as I have never paid anything for any of my immigration process so far (11 yrs in US). Technically, you are not supposed to pay anything, only employer should pick up the fee. You can pay the premium processing fee wherever applicable.

    I first took 2 photos for me and 2 photos for my wife from Walgreens @7.99 per 2 copies. But the quality is not at all good.

    So we went to Costco today and took the photos @4.99 per 2 copies and the quality is very good and they followed the USCIS specs.

    I read through this proposed legislature and there is absolutely nothing to worry about.
    your valid drivers license is clearly mentioned as one of the acceptable proof of legal status. you need to be arrested or there should be obvious reason to suspect ilegal presence for the law official to ask proof of legal status. Why is that of any concern? That is perfectly normal in a legal society. You dont have to walk around with your 797 or 94s all you have to carry is a valid drivers license. Even if you dont have a license you will be given a chance to proove your legal status or inother words the decision is not made on the spot.
    Again for those unfortunate who are here ilegally this law might become an issue. But we might end up seeing inflation as a result of these crack downs. More industry particularly packing/agriculture might migrate oversees. Anyway we will wait and see.


    You say all these because you understand. Most of these police officers out there (and even Immigration Enforcement officers) dont understand the laws they are enforcing. I once asked an american embassy consular officer during an H1B renewal interview how long I had to stay in the US if I get laid off from my job. She smiled and said she doesnt know. Ironic right? That is US Immigration laws for you. So complex yet so unreasonable.

    You would need employee letter as well. The employee letter will state that the position is still open and they are willing the pay the amount that was initially agreed to while filing for labor.....so pay stub is not enough.....

    My lawyer as well as my wife's lawyer confirmed that an employment letter is not required if using pay stubs. Several posters on this forum have gotten the same information from their lawyers. Anyway, let's not get into a debate on who's correct or incorrect.

    It's a different thing to have the employment letter to make the case stronger (probably), but you will definitely not get a RFE for using the pay stubs. And in "sats123"'s case, this is a less expensive and reliable option.

    Of course, one could argue it's worth paying $5000 if it ensures a smooth adjucation, but then that would depend on the financial situation of the applicant. I cannot comment on that for "sats123".

    Having written all this, please check with your own lawyers and do what they advise.

    Looks like we are all frustrated, and it is proving beyond doubts.:(

    It is best to wait for USCIS to announce this. If this is going to be true, then lots of people who had the hopes of applying for their I140 is just gone.

    IV core team, can you please find out more information on this and let the members know.
