Is there a formal way / method to let the company and USCIS know of such discrimination ? Any published guidelines from USCIS ?
My wife works for TCS and is on vacation .We tried contacting the local office here .Though the guy mentioned that they have projects ,he still wants her to goto India and comeback on TCS visa and sent her a email that TCS policy doesntnot allow EAD holders.

Pursuant to our conversation today, I am forwarding the reply from the Nebraska Service Center of the U.S. Citizenship and Immigration Services (CIS) regarding our inquiry into your application for Adjustment of Status (I-485).
Our office initiated an inquiry into your case as a result of your correspondence dated September 12, 2007 sent to Congresswoman Maxine Waters. If you receive or do not receive a notice of action from CIS within the next 30 days please notify our Immigration Caseworker, Blanca Jimenez at ext. 18.
Thank you for contacting the office of Congresswoman Maxine Waters to assist you in this matter.

Good Morning Ms. Jimenez,
I do not show that we have data-entered Mr. XXXs I-485 yet. The I-485 must be in line to be data-entered because we receipted an I-765 (LIN-07-245-XXXX).
The I485 application is still pending at this office. Although the Department of State Visa Bulletin indicated visas were available for most employment categories USCIS still has to adjudicate every application. NSC has approximately 26,000 I485 applications that may have a visa available and we are reviewing them as expeditiously as possible. This application is in line to be worked but it will take time. Please allow an additional 45 days for NSC to adjudicate the application. If you have not received a notice from NSC after 45 days you may submit another inquiry.

Respected Ms Waters,
Sub: USCIS inefficiency for Legal Immigration
I send my I-485 AOS application to USCIS and received on July 2nd 2007 at Nebraska Service Center, Lincoln, NE.
It's almost approx 75 days since the application received at USCIS and have not received the Receipt Notice or any notification from USCIS.
I tried to contact Customer Service at USCIS. They don't provided any information. USCIS website updates show they are processing 08/01 or later for AOS application. They are not following the First In First Out(FIFO) order.
I need help of your good to know the status of my I-485 application.
My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.
The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.
Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).
Any inputs or clarifications will be greatly appreciated.
every lawyer who has OKed multiple 485s has specifically asked us to apply for EAD/AP on only one of the applications.

This is time for us to work together, leaving all differences aside.
Thats sum it nicely. Nobody wants to go back.
Though you are sending "I am going back unless you fix it" cards, you are actually not serious about it. Great. Just Great.
And you think, that will fix the system.
To the "brave" person who gave me red dot with this comment
u r a sicko...even after getting citizenship u r here and that says a lot...looks like you've no friends and family. Feel sorry for u - Loner.
Hope you are feeling better after venting out your frustration. It was so nice of you to leave "anonymous" comments.
Good Luck to you.
Wishing the very best for you!
2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
3) Assumption - USCIS distributes equal share among these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.
EB3 All = 40040 ( 0.286 x 140000)
EB3 ALL = EB3 I + EB3 C + EB3 M + EB3 P + EB3 ROW
Assuming equal share of all of these 5 subscription categories - 40040/5 = 8008 applications to be worked for "Assigning the visa number" not " for granting the visa (IN other words physical greencard order)"
7% + 2% = 9% country specific limit is meant for "Granting the visa - Ordering Physical Green card" out of "Applications which have been assigned a visa number"
Number 2) and hence number 3) are definitely wrong.
As I mentioned in my other post, the categorisation for I,P,C,M and ROW is based on the fact that I,P,C,M are the only countries with demand exceeding the annual limit.
ROW = All countries not hitting the 7%(or 9%) country limit. That doesn't mean they are capped at X/5. What would be the basis of that cap.
Assuming USCIS acts like it is supposed to, follows all rules etc........They start using new numbers on Oct1st of the new FY with a fresh slate of 140k available.
Now by law, they will first divide the cap into the 5 EB categories -EB1, EB2, EB3, EB4 and EB5. Now once they reach the 7%(or 9) cap in any of the categories, they will have to stop assigning numbers for that country. So for EB3, once they reach the 7 or 9% quota for I,C,M,P - they will need to stop. The rest of the countries(ROW) will get the 100 - (7 x 4) = 72% of the quota. This could be divied up between UK, France, Pak, Germany etc etc. As none of them are going over the 7%, the country cap doesn't affect them. But Since there are a lot of apps under EB3-ROW, there's never any number to spill over to the capped countries.
In case of EB2, only 2 countries hit the cap - India and China. In this case even P and M are part of ROW. But since the apps from ROW is less than the remaining quota of (100 - 7 x 2)% of the EB2 quota, the remaining will be spilled over. The spillover rules will determine who these go to.
The way the current spillover rules stand, your final calculations will still hold true for EB2 due to the spillover ultimately remaining the same to EB2. But not for EB3.

We are getting carried away and forgetting the main reason this campaign was started: draw attention to EB retrogression, USCIS wastage of visa numbers etc

I am happy I switched to vonage just last week - enjoying the call quality. If vonage and teleblend cost same, I better be with a bigger VOIP company.
I agree with what you are saying. But, we need to compare the taxes too. Not sure of the taxes charged by vonage when compared with teleblend.

Please don't miss this chance:
Please send details to CIS Ombudsman office with scaned delivery Proof for pending applications. Please mail him all the details. He want to see the trend. No efforts are useless.
USCIS is again not admitting that they are not following the FIFO and per USCIS, we should have got our EAD by now also. :D
Do you have postal address or fax of Ombudsman office readily available with you? I remember having seen it, but can't quickly find it. I will send my details to Mr. . USCIS simply brushed aside the issue of FIFO by just saying that it could only be a rare case of an error or special attention needed, which obviously is not true.

Still you save on an average $85 a year... not a bad deal
33.38 per month x 12 = 400.56 - 315 = 85.56 (savings)
315 / 12 = 26.25 per month
